General Terms and Conditions

Status: March 2025

1. scope of application

The following contractual conditions comprehensively regulate the mutual rights and obligations between Campingplatz Rühler Schweiz GmbH (CRS) as the operator of the campsite or landlord and the camping guest or tenant. Only the offers confirmed by CRS by e-mail or post for the travel period apply to the contractual services. Telephone agreements, ancillary agreements and other agreements of any kind must be made in writing and confirmed by CRS in order to be valid.

2. general duties of use

The camping guest is generally obliged to behave well, to keep the campsite clean and to observe the rest periods. The camping guest is personally liable for all obligations arising from the conclusion of the camping contract or the stay on the campsite. This also applies to third parties registered by him.

Only one camping object, i.e. a family tent and car or a caravan and car or motorhome, is permitted per camping pitch. An awning or awning may be used for this purpose. Additional tents for visitors are not permitted.

The number of persons in the rental properties is limited to the maximum permitted occupancy. Additional camping in a tent or similar and pavilions at the rental property are not permitted.

3. booking/prices

With the registration/booking, the camping guest makes a binding offer to conclude a camping contract. The camping contract only comes into effect with the written booking confirmation (by post or e-mail) from CRS. You will receive the booking confirmation after a maximum of 5 days, please check it immediately for correctness!

CRS reserves the right to make equivalent changes to the booking if this appears necessary for special reasons.

Bookings by single travelers under the age of 18 are not permitted and will be canceled by CRS. For all vacation periods, especially the summer months and public holidays, early booking is strongly recommended. Please note possible minimum booking periods.

4. down payment/payment/invoice

For all online bookings (including vacation rooms, caravans, mobile homes, tents, sleeping barrels) we charge a deposit of 100% of the travel price. For all other bookings, we also charge a deposit of 100%, payable within 4 weeks of booking confirmation.

If payment terms are exceeded, we reserve the right to send a payment reminder and the right to cancel the order for a fee. Payment terms deviating from this are only possible by arrangement and require written confirmation from CRS.

For legal reasons, the invoice address can only be changed up to one day before departure at the latest. Please note this especially for company invoices!

5. arrival

The arrival and departure dates stated in the booking confirmation are binding. Camping pitches and rental properties are available from 15:00 on the day of arrival. Should your arrival be significantly delayed, please inform us. If you do not notify us, we can only keep the rental property or camping pitch available for you until max. 14:00 on the day after your planned arrival and will then allocate the property or pitch to someone else without compensation.

6. departure/keys

Vacation rooms, rented caravans and sleeping barrels with basic cleaning by CRS must be vacated by 10:00 am. The basic cleaning of these objects is always carried out by CRS or an authorized cleaning company. Camping pitches must be vacated by 12:00 noon at the latest. Departure must also take place by 12:00 noon.

The keys and handover protocols for the rental properties must be handed in at reception at the time of departure. The loss of a key will be charged at € 50.00 per key.

7. rebooking

If you have changes made to the existing contract (persons, camping pitch/rental property in the same category or larger, postponement of arrival or departure day by 1 to 2 days), we will charge you the new price per rental property/pitch. As a gesture of goodwill, we do not charge a processing fee.

Rebooking to another period: If you wish to change the travel period completely, this is possible. The rescheduling must be declared in writing before the start of the trip and the new travel period must be specified within 14 days. The new travel date must be in the same or following calendar year. If the rescheduling is made for the first time, we will not charge a rescheduling fee as a gesture of goodwill. Requests to change dates that do not comply with these requirements will be treated as a regular cancellation.

If the new travel date is canceled, the current cancellation fees will apply. Rebookings or transfers to third parties are not possible.

Rebooking to a third party: If you are unable to make the trip yourself, you can transfer the entire booking to a third party before arrival. In this case, we will charge you a € 25.00 rebooking fee. You remain jointly and severally liable for the invoice of the replacement tenant. A partial transfer of a few days is not possible.

8. withdrawal/cancellation

You can withdraw from the contract at any time! Withdrawal must be declared in writing. The date of withdrawal is determined by the date of receipt of the declaration of withdrawal by post or e-mail.

If you withdraw from the contract, we will charge a one-off processing fee of €25.00 per rental property/parking space as well as reasonable compensation in accordance with Section 537 (1) of the German Civil Code (BGB)
as listed below:

In the event of a later cancellation, later arrival, early departure or in the event that you do not start your trip without informing us, we retain our claim to 60% of the total price confirmed at the time of booking.

Rental properties and camping pitches that are not occupied by 2 p.m. at the latest on the day after the planned arrival and for which no agreement has been made regarding later occupation may be used by CRS for other purposes. The occupation of a pitch or rental property by CRS does not constitute the provision of a replacement tenant, as the guests could generally be accommodated elsewhere.

9 Cancellation, trip cancellation and curtailment insurance

We strongly recommend that you take out cancellation and curtailment insurance. This insurance is valid from the time of booking until departure. The insurance comes into force if one or more registered persons are unable to travel or have to leave early for the following reasons: sudden illness or injury so serious that a stay is not possible from a medical point of view, or the death of a first-degree relative. Other reasons are excluded. If you are unable to travel for one of the above-mentioned reasons, the insurance will reimburse you for the cancellation costs incurred, subject to a deductible of 20%. Cancellation or withdrawal is only valid if CRS is notified in writing before arrival or before early departure and a corresponding certificate, e.g. a doctor’s certificate or death certificate, is submitted within 14 days.

10. parking/e-cars/license plate recognition

A parking space for one car is available on each pitch or at each rental property. Each additional vehicle is subject to registration and charges. Rental parking spaces are available for a fee. Please ask at reception for more information. Free parking spaces, also for visitors, are located above the campsite.

Charging e-cars at the rental properties or parking spaces is prohibited!

The barrier opening for access to the site for the license plate number specified in your booking is automated by means of license plate recognition. Only the license plate number is recorded (no persons), the legal basis is Art. 6 para. 1 lit. b i. V. m. lit. f GDPR.

11. parcels/packages

CRS does not accept parcels and packages from guests. Please only have parcels forwarded to our campsite in absolute emergencies and by arrangement with reception
(e.g. medication/medical equipment). Otherwise parcels must be sent to the packing stations
in the area.

12th visit

Only registered persons are permitted to stay on the CRS site. Campsite guests must register their visitors at reception and pay an entrance fee. A separate pitch must be booked for additional tents, caravans or motorhomes.

13. groups

Groups are registered clubs, school classes or companies of 10 persons or more with at least one responsible supervisor, but only by prior arrangement. CRS reserves the right to charge a deposit for groups.

14. swimming pool, playground and other areas

Use of the swimming pool (except for visitors) is free of charge. Of course, the use of the playground and the green areas adjacent to the playground, where tenants can play volleyball or other sports, is also free of charge. None of these uses are included in the accommodation price and are therefore not part of the contract.

15. dogs/pets

Bookings with dogs are permitted with a few exceptions. Pets are only permitted in selected vacation rooms and sleeping barrels in the rental accommodation.

Dogs are not allowed in the playground. Dogs must be kept on a lead on the entire site. In the event of conspicuous behavior or complaints, CRS may expel the dog from the site.

16. opening hours/frost

In the months of November and December and from January to March, the reception is only staffed to a limited extent and the swimming pool is closed. Please note that fresh water is only available on the pitches if CRS does not expect frost. Furthermore, not all sanitary buildings are open.

17. noise pollution

The campsite is located in a very quiet area. In the unlikely event of a disturbance of the peace from outside the campsite, CRS excludes all liability for such disturbances.

18. liability

Every guest undertakes to treat the inventory and the campsite with care. They are obliged to compensate for any damage caused by them, their companions or guests during their stay. For all damage caused by incorrect or faulty electricity installations from the electricity distributor, the camping guest himself is liable to injured third parties.

CRS is only liable for intent and gross negligence as well as for damages resulting from an intentional or grossly negligent breach of typical contractual obligations. Liability for damage, accidents, losses or other irregularities arising in connection with the use of the site is excluded. Influences of force majeure, e.g. weather, strike, legal orders, exclude any liability.

CRS is also not liable for damage caused by the failure or disruption of the water, electricity, oil and gas supply or for noise nuisance caused by third parties. Furthermore, CRS is not liable for slightly negligent breaches of duty for damage caused by the use of the facilities or equipment located on the campsite, this also applies to facilities, equipment and precautions that are out of order or out of service, as well as for slightly negligent breaches of duty by the legal representatives or vicarious agents of CRS.

Insofar as exclusions of liability are not permitted by law, liability in accordance with the statutory provisions shall only apply in the event of attributable injury to life,
limb or health.

19 Complaints

Any complaints regarding the rental property or the pitch must be reported to CRS immediately by the camping guest. The assertion of defects is excluded if these have not already been reported to CRS by the camping guest during the stay. CRS must be given a reasonable period of time to remedy the defect (rectification).

20. WLAN access/use of external WLAN receivers, repeaters and use of external antenna technology

CRS offers its guests access to the Internet in the form of WLAN access (hotspots). The provision is free of charge, voluntary and is not part of the contractually agreed service. The transmission speed may be subject to fluctuations and disruptions.

As a rule, surfing the Internet and sending and receiving e-mails is made possible at various locations. CRS reserves the right to change, restrict or discontinue hotspots without prior notice. There is no entitlement to a specific local coverage of the hotspots.

The use of Wi-Fi repeaters is generally permitted. The following conditions must be observed by you as a user of our guest WLAN (if these rules are not observed, we reserve the right to remove guest devices from the WLAN network):

1. it is prohibited to broadcast or amplify the existing WLAN network with the SSID of CRS. You are welcome to use your repeater as a client at your location or configure it so that it broadcasts a different SSID. Please refer to your hardware manufacturer’s operating instructions for details.

2. the statutory regulations on the use of frequency bands and permitted transmission powers must be complied with. This applies in particular to the use of external antenna technology.

21. site regulations

All stays are subject to the site rules, which are displayed at reception, handed out on request and available online. Anyone who grossly violates these and in particular the quiet times despite being warned will be expelled from the site immediately. In this case, there is an obligation to pay for the entire stay, unless the camping guest can prove that less damage has been caused.

22. data protection

CRS processes your data for the booking order in accordance with Art. 6 para. 1 lit. b GDPR, as well as for marketing purposes, provided that we have your consent in accordance with Art. 6 para. 1 lit. f GDPR. 1 lit. a DSGVO have. It will not be passed on to third parties.

Video surveillance: The CRS site is monitored by video cameras in critical areas. GDPR-compliant signs indicate the relevant areas. This is done on the basis of Art. 6 para. 1 lit. f GDPR (prevention of theft, vandalism and criminal offenses, exercise of domiciliary rights). The recordings are only evaluated if necessary and only the required data is stored until clarification. Data will not be passed on to third parties outside of the purpose limitation. The deletion of the data is automated in accordance with. Art. 17 para. 1 lit. a GDPR in conjunction with Art. 5 para. 1 lit. c and e GDPR after 48 hours. The recording device must be protected by appropriate measures in accordance with Art. Art. 32 GDPR from access by unauthorized persons.

23. changes to the catalog information

Only the prices and dates stated in the booking confirmation are binding. The offers and prices in our printed price lists correspond to the status at the time of printing the various documents (flyers etc.). Please understand that prices and services may be subject to change for factual reasons until your booking request is submitted, and that we therefore expressly reserve the right to make such changes. For example, an increase in energy costs, mineral oil tax, VAT or other taxes etc. may result in a price increase if the consumer price index rises by more than 2 points as a result. We will inform you of these changes in good time.

24 Dispute resolution procedure

The company Campingplatz Rühler Schweiz GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

25 Final provisions

By making a booking, the camping guest confirms that his/her personal details are correct. By accepting the booking, he recognizes these GTC including the campsite regulations. The statutory provisions and the law of the Federal Republic of Germany apply.

The exclusive place of jurisdiction for all disputes arising from the contract is Holzminden for both parties if the camping guest is a registered trader, has no general place of jurisdiction in Germany or his place of residence or habitual abode is not known at the time the action is brought. Otherwise, the general place of jurisdiction shall apply.

Should individual provisions of the General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision whose economic success comes as close as possible to that of the invalid provision.
